Welcome to Seercraft. These Terms of Service ("Terms") govern your access to and use of the Seercraft platform at seercraft.io ("Service"), operated by Seercraft ("we", "our", or "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. Account Terms

You must be at least 16 years old to use Seercraft.
You must provide accurate and complete information when creating an account via Google OAuth.
You are responsible for maintaining the security of your account and any activity that occurs under it.
You must notify us immediately of any unauthorized access to your account.
One person or entity may not maintain more than one free account.

2. Subscriptions and Billing

Plans and Pricing

Seercraft offers subscription plans (Starter, Pro, and Agency) with monthly and annual billing options, as well as pay-per-usage credits. Current pricing is available on our Pricing page.

Billing

Subscriptions are billed in advance on a monthly or annual basis, depending on your chosen billing cycle.
All fees are non-refundable except as required by law or as expressly stated in these Terms.
Pay-per-usage credits do not expire and are non-refundable.

Cancellation

You may cancel your subscription at any time through your account settings.
Cancellation takes effect at the end of the current billing period. You will retain access to paid features until then.
We reserve the right to change pricing with 30 days' notice. Continued use after a price change constitutes acceptance.

3. Acceptable Use

You agree not to:

Use the Service for any illegal or unauthorized purpose
Attempt to access, tamper with, or use areas of the Service that you are not authorized to access
Reverse engineer, decompile, or disassemble any part of the Service
Interfere with or disrupt the integrity or performance of the Service
Use automated means (bots, scrapers, etc.) to access the Service beyond its intended API
Resell, sublicense, or redistribute access to the Service without our written consent
Use the Service to infringe on the intellectual property rights of others
Upload or transmit malicious code, viruses, or harmful data
Harass, abuse, or harm other users of the Service

4. Intellectual Property

Our Property

The Service, including its design, features, code, content, branding, and AI models, is owned by Seercraft and protected by intellectual property laws. Nothing in these Terms grants you ownership rights to the Service.

Your Content

You retain ownership of any content you create using the Service, including boards, briefs, notes, and saved collections. You grant us a limited license to process, store, and display your content solely to provide the Service.

Ad Data

Advertisements displayed through the Service are sourced from publicly available ad libraries. Seercraft does not claim ownership of third-party ad content. Ad data is provided for research and analysis purposes only.

5. AI-Generated Content

Seercraft uses AI to generate creative analyses, briefs, and insights. You acknowledge that:

AI-generated content is provided as a creative aid and should be reviewed before use
We do not guarantee the accuracy, completeness, or suitability of AI-generated content
You are responsible for how you use AI-generated content in your work
AI outputs may be processed by third-party AI providers (e.g., OpenAI) subject to their terms

6. Data and Privacy

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the data practices described in the Privacy Policy.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service.
We may suspend or restrict access for maintenance, updates, or security reasons with reasonable notice when possible.
We reserve the right to modify, suspend, or discontinue any feature of the Service at any time.

8. Limitation of Liability

To the maximum extent permitted by law:

The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
Our total liability to you for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
We are not responsible for any loss of data, revenue, or business opportunities resulting from use of the Service.

You agree to indemnify and hold Seercraft harmless from any claims, damages, losses, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms, with or without notice.
You may delete your account at any time by contacting support.
Upon termination, your right to access the Service ceases immediately. We may delete your data in accordance with our Privacy Policy.
Sections on Intellectual Property, Limitation of Liability, Indemnification, and Governing Law survive termination.

11. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes shall be resolved through good-faith negotiation first, and if unresolved, through binding arbitration in accordance with applicable arbitration rules.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of Seercraft after changes are posted constitutes acceptance of the updated Terms.
